Website Project Terms and Conditions of Amhazing Solutions Pty Ltd (Hire a Website)

We pride ourselves on delivering professional cost-effective internet solutions with visible return on investment for our clients. The following terms and conditions are in place to allow us to deliver web projects to our clients within the estimated budget.

Adhering to the prescribed terms and conditions allows for the best use of available resources for both you and us. For the reassurance of clients any additional charges required will be identified in advance.

* Website development will only commence when the nominated initial payment has been received and funds cleared.

* At the beginning of the website project the client is required to identify key contacts and decision makers who will oversee this project and be available for comment and support of the development process. Rework of completed website work due to incorrect client decision making process may incur extra charges.

* If the client places the project on hold the client will be required to pay for the work completed to that point. If only the final project sign off is required the remaining balance is still deemed to be due.

* If development is suspended due to a delay in client deliverables or late payment then priority may be given to other projects and the related project may have to be re-scheduled into production.

* The completed project will not be launched until final payment along with final sign off has been received.

* From time to time projects are delayed due to 3rd party suppliers, this may require development to be suspended and re-scheduled once the third party supplier provides necessary material.

* Included with proposals will be a specified amount of design concepts & design revisions. Any additional re-designs or revisions will incur an additional fee charged at our standard hourly rate. To ensure the first design is as effective as possible please ensure you communicate all design requirements and specification before commencement of the Design Phase.

* Included within your proposal will be the number of web pages you’ve requested including a Site Map and Contact Page. Additional pages will incur additional costs. It is considered that one standard web page is equivalent to one A4 page. Additional pages managed by the Content Management System (CMS) Joomla! may incur higher additional charges per page due to the complexity in the content & functionality displayed.

* Included in the budget of the proposal are a number of revision stages. Each revision stage requires changes to be submitted at one time. Revisions submitted on multiple occasions may incur an additional charge.

* All website projects have a Management resource allocated. Excessive client communications & support may result in extra project management investment required which will be billed at our standard rates.

* Billable maintenance and modifications will be provided at our standard hourly rate for website development. You will be billed at the completion of the revisions or modifications according to the hours worked.

* We require any related materials including logo’s, images and content to be delivered as soon as possible once the proposal has been accepted and signed. If we are required to contact third party suppliers and source relevant material, project management costs will be charged at our standard rate.

* If content is not supplied in a suitable digital format for web development the client may incur additional fees for the conversion of the data at our standard hourly rate. Suitable digital format for web development means content including, but not limited to, text, pictures, video and audio supplied in a Microsoft Windows personal computer (PC) digital format. Conversion from Mac to PC, if required, will incur additional fees.

* All content & images supplied to us are required to be fully proofed and approved before submission to for inclusion in the website. Updating of already submitted content may incur additional costs charged at our standard rate. Extra image manipulation cost may be incurred if images are not submitted in the file format and resolution we've requested.

* To best facilitate to website production process by my team given the various locations of clients, all meetings & training will generally be undertaken by phone unless otherwise agreed. We may at our discretion choose to meet with clients offsite and in certain situations the client may be charged for time & travel. The client will be informed beforehand if charges apply.

* Unless contained as project investment item, we don't provide support for client’s internal IT infrastructure including web browser configuration, internet access & email client configuration. We will endeavour to be helpful but reserve the right to request the client seek professional IT support or incur additional charges.

* We are happy to extend to our clients all intellectual property rights over any material uploaded to the web server, where we are able to do so. Intellectual property rights to source files remain our property as they generally incorporate proprietary technology. If an items is released under GNU then the copyright still remains with us.. Release of source file intellectual property to clients may be incur extra charges.

* We reserve the right to include a discreet credit in the bottom footer of the website, typically listed after client copyright information. This credit will link back to the our website.

* We reservee the right to also promote the client as being a client (e.g. showcase, past projects, current client pages in this site) and include the client’s logo, name and contact details in marketing and advertising programs. Where the web project is not in the public domain (ie Live) , we will not promote the client or project until the project is in the public domain.

Support Terms and Conditions

* Reaction shall occur within 2 working days from receiving a request in writing from the customer.

* The customer accepts unconditionally that the service is distributed on an as is basis without warranties of any kind, either expressed or implied.

* The customer is particularly obliged not to send spam or undertake any unlawful practices.

* The customer is obliged to keep contact details up to date.

* The customer cannot take any action which imposes an unreasonable or disproportionately large load on the website network or other services infrastructure.

Disclaimer of Warranties, Limitation of Liabilities

* The service and website are distributed on an as is basis without warranties of any kind, either expressed or implied.

* We do not warrant for the website and the service it is providing. We disclaim any warranty of title, merchantability, non-infringement, or fitness for a purpose state or desired by the customer. We do not warrant that the service will be error free or uninterrupted.

* We are not responsible for any delay or failure in performance due to Force Majeure, or other occurrences that are beyond our reasonable control. We are not responsible for short, temporary and accidental suspension of the service as a result of circumstances which we could not foresee or suspect.

* The customer recognizes that we do not own or control other networks, information and systems outside of your network, nor are we responsible for performance or non-performance within such networks. We exercise no control over and specifically deny any responsibility for the content, information, accuracy or quality of the information and/or data passing through its Network or the service provided.

* The use of the service is at the customer's solid risk. We are in no way responsible for the conduct of our customers, the content of the pages created, saved and displayed through the service. We are not responsible for any indirect, incidental, special, punitive, or consequential damage that results from customer's or customer's visitors' use of the service, including, without limitation, any such damage for loss resulting from use or the misuse of the service.

Final Provisions
* We reserve the right to modify, add or delete any documents, information, graphics or other content appearing on or in connection to our web page including terms of service at any time without notice.

* This service shall be interpreted and construed according to, and governed by, the laws of Australia, excluding any such laws that might direct the application of the laws of another jurisdiction. The law of Queensland, Australia shall be jurisdiction.

Technical Limitations

The internet is a relatively new and rapidly evolving medium and as such the standards for hardware, software, security, content, imagery and intellectual property are constantly evolving on a daily basis. Because of the nature of the internet, we will be required to make decisions, regarding your web project on your behalf, which are based on the current internet state of play and our expertise as experienced web professionals. We ask that clients respect the dynamic, unstable & complicate nature of the medium and the decisions we make on their behalf.

If clients have any particular preferences they must be stated at the start of the project as they may affect implementation strategy & final project investment. Some typical considerations include:

* Supported web browsers such as Microsoft Internet Explorer & Mozilla Firefox (or perhaps Mac?).
* Cross platform web browser testing & support.
* Supported web browser Plug-ins & versions such as the Adobe Flash Player.
* Browser Settings such as JavaScript disabling & Pop-up blocking.
* Design for standard screen resolution & initial visible area above & below the fold.
* Level of support for W3C standards & accessibility.
* Download speed of web pages, browser caching, web server upgrades, caching, loading and uptime.
* Content Management System support, functionality & level of edit ability.
* eCommerce security & online payment gateway configuration.
* Email marketing campaigns cross platform readability & deliverability.
* Email spam filtering.
